An Open Letter to the Predator

Plain and simple fiery rage.

Nothing else, not yet. It'll have to wait.

Destruction of a child's purity, his innocence, his aidelkeit.

He looks to you, Rebbe, as a model of trust.

Not, O ill one, for a coddle of lust.

Have you forgotten your charge, your mission?

What do you think gives you the right, the permission?

The pain, the hurt, the shame, the fear.

Could they have possibly been any more clear?

The Chillul Hashem. Ashen-faced Rabbanim.

Rebbe, Lo Sikach Ha'Eim Al HaBanim.

Whew! I was hoping there was enough on "those type of blogs" that you wouldn't refer to this topic.Once you did I will say my comments.I don't know any details of the case though the accused was my rebbe 30 years ago I never saw anything in him to make me believe the allegations and being that now this story carries no relevance to me he remains deserving the chiyuv D'AROYSA of dan l'kaf zchus.(B'tzedek tispot es amisech)Which brings to my main thoughts on the topic:I am amazed by the willingness of the vast majority of people to accept as truth a one sided biased article written against someone as truth.Worse is the acceptance on the blogs the besmirching of the torah implied in that article.I don't want to elaborate because having seen what happened to those who attempted to defend the rebbe or the RY on other blogs I realize any defense will result in more speculative motzey shem ra but I am saddened by those who seem to be calling for witch trails in secular courts. The Torah gives us guidelines and recourse for what to do in such cases yet few seem aware of or concerned by them.Chavel!

I steered clear of making any allegations against anyone in particular. The letter could be addressed to anyone of the Rebbeim who have been found guilty of this, and I just can't help escape the knowledge that, generally, while not referring to this particular incident, these things go on for too long before anything happens.

I appreciate your trying to help see the other side of the coin.

I am work now so I will have the siman and seif for you tomorrow. the basic halacha is that it must be kim leih to B.D. that the plaintiff is a gavra alimah (or presumbly the defendant can bring proof of that) then the witnessess must testify that they aren't willing to say the knowledge they have. After that the onus is on the plaintiff. To fully understand this go through the sugyah of mari bar esaik in perek Hamafkid alivah d'hilcshoh.Tomorow bl'n I will give exact mekoros.

Allow to give the mekoros for anon while adressisng the terrible chilul hashem of blog posters claiming how beis din is corrupt and powerless and therefor allows abuse.(1)BBova Metziah 39b is the story of mori bAr asek.See the rmbm hilchos edus 3:12 as well as tur and shulchan orech 28:5 with all the nose kailem to understand how beis din deals with intmadataters(simelar but not exactly like anonn says)(2)see bova basra 21b for the famous expresion that a melamad needs no warning to be fired even if he is negligant in teaching kal v'chomer in a case of abuse.See SO 306:8 for details.(3)Even if one feels some batey dinim are corrupt anyone can convene his own ZBL"A beis din and chose and agree on his judges.(4)With all the garbage howabout due to LSHR things get supressed A beis din has the right to publicize a ksav seruv or a ksav lo tzios l'dinah. To be accurate the beis din doesn't publicize rather they give it to the baal din to do so .There are few things more devestating in frum society then having one put out against you so noone and surely not a public figure like a RY is in the posotion to ignore a beis dins psak or findings(5)This bussiness of LSHR prevents abuse victims from speaking out is nonsence as it goes against Al Tamod Al Dam Rayech;while a rov told such allegations may not accept them and conduct a witch trail he MUST be suspicous and clarify to the best of his abilty(6)noone who reads the jewish observer and sees the crediblty and veneration given by orginazations like agudas yisroel, torah umesorah and thier rabbis to socail workers could possibly believe that rabbis would ignore it if the CSWs would notify them of treating many people who had been molested by thier rabbayim and as above the CSWs would be required to have done so due to al tamod.I have only written this to express my pain at seeing all the attacks on the torah and its adherants on other blogs;if you disagree with me the knowledge that you are in the majority should allow you to keep silent at least on this one blog.

I will only say that my mother works on a crisis line in Israel and the problems of abuse are definitely there. I won't use any kind of word that may over-quantify the problem, but it's not one or two.

I have not made, and will not make, any allegations against the Battei Din or the frum umbrella organizations.

Let us wait and see how this gets handled, and daven that no one gets hurt where it is undeserved.

Fair enough?
